Strong odors from an asphalt factory sheet (18/02/2011)

The Department of Environment of the City of San Pedro del Pinatar, led by independent Councillor Pinatar Centre Union, Mark David Gracia Antolinos, for 18 months apart, echoed the complaints of many residents of San Pedro del Pinatar by strong odors from an asphalt sheets factory located in the Place de Las Pacheco-Los Tárraga of this town has commissioned several studies to clarify the origin of the same mark as the skills of their council.

The analysis of data from this study was completed last week and has already been made aware of the three owners in the interior of houses, located next to the factory of asphalt sheets, samples were taken and the owners factory odors causing air pollutants.

In summary, the content of the study is available to citizens, clearly identifies the source of the odor nuisance to the neighbors come from the asphalt plant, as the air sampling were conducted taking into account the prevailing winds, showing when the wind was going from factory to housing the chemicals that cause odors were present in the houses.

Given that the Superior Court of Justice (TSJ) in Murcia has recently issued a statement condemning the Municipality of San Pedro del Pinatar to pay 500 € a month for a family, since it has "violated the right to privacy and inviolability of the home "by the entry of odors in it.

This fundamental right is enshrined in Article 18 of the Spanish Constitution.

The ruling of the Tribunal Superior de Justicia de Murcia hints that payment must be made as the City would not solve the problem of intrusion of odors in homes that cause a clear violation of fundamental rights.

For all these reasons and because it is clearly established by various means the source of odors, the Department of Environment has asked the company to cause odors, SA SOUTHEAST ASPHALT, to halt immediately the emission of these compounds redolent of the atmosphere as a pollutant are the same.

These same reports and the Supreme Court ruling was sent to the Directorate General of Planning, Evaluation and Environmental Control for Autonomous note, as it is in the process of Environmental Impact Assessment of the activity of the plant responsible for the odor nuisance and were more than 70 residents who made claims to it, highlighting the nuisance odors.
